Terms and Conditions

These Terms of Service ("Terms") are a binding contract between you ("you," "Customer") and 3D Services USA, LLC, a Wyoming limited liability company ("3D Services USA," "we," "us"). They govern your access to and use of our website, instant-quote and ordering platform, and all manufacturing, CAD, engineering, and design services (collectively, the "Services").
By creating an account, uploading a file, requesting a quote, or placing an order, you agree to these Terms and to the policies incorporated by reference in Section 21. If you do not agree, do not use the Services.
1. Accounts
- You must be at least 18 and able to form a binding contract. Business users represent they are authorized to bind their organization.
- You are responsible for the accuracy of account information and for all activity under your credentials. Notify us immediately of unauthorized use.
- We may suspend or terminate accounts that violate these Terms or the Acceptable Use Policy.
2. Uploads and Customer-Supplied Files
- You may upload 3D models, CAD files, drawings, and specifications ("Customer Materials") in formats we support (including STL, OBJ, STEP, IGES, 3MF).
- You represent and warrant that you own or have all rights, licenses, and permissions necessary to upload the Customer Materials and to have the resulting items manufactured, and that doing so does not infringe any third party's intellectual-property, contractual, or other rights.
- You grant us a limited, non-exclusive license to store, copy, analyze, reformat, prepare, and use the Customer Materials solely to provide the Services (including geometry analysis, quoting, slicing, manufacturing, and quality control). This license ends when we delete the files under our retention schedule. We may keep records we are required to retain for legal, tax, or dispute-defense purposes.
- We are not obligated to review Customer Materials for accuracy, manufacturability, fitness, or legality, and we manufacture to the files and specifications you provide. Errors in your files are your responsibility (Section 9).
3. Manufacturing and Engineering Services
- We provide made-to-order manufacturing (including FDM and resin/SLA 3D printing), and engineering and design services that may include CAD modeling, reverse engineering, concept development, product design, mold and tooling design, prototyping, and low-volume production.
- Custom-Manufactured Products are produced specifically for you to your file, configuration, or specification. They are not stock goods and are non-returnable except as stated in the Refund & Return Policy.
- Service-specific terms, including ownership of work product we create, are governed by Section 13 and the applicable Statement of Work or accepted quote.
3A. Custom-Manufactured Goods Acknowledgement
By placing an order, you specifically acknowledge and agree that:
- Every order is manufactured specifically for you, to your file, configuration, or specification.
- The products are made-to-order and are not mass-produced, stock, or off-the-shelf consumer goods, and have no resale value to us.
- Additive manufacturing produces inherent process artifacts (including layer lines, support marks, seams, minor warping or shrinkage, and surface, color, and finish variation), and you understand and expect these artifacts as normal outcomes of the process (see Manufacturing Policy).
- Your products will be evaluated for acceptance against your specifications and the Quoted Tolerances, and not against subjective expectations, idealized renders, or comparisons to mass-produced goods (see Quality Acceptance Policy).
- This acknowledgement is also presented for your separate affirmative acceptance at checkout, and your acceptance is recorded as part of the order record (Section 16; Refund & Return Policy).
4. Manufacturing Limitations, Tolerances and Variation
- Additive manufacturing is a process with inherent and unavoidable variation. By ordering you acknowledge and accept the limitations described in the Manufacturing Policy. These may include, without limitation: visible layer lines, support-contact marks, seam lines, minor warping or shrinkage, anisotropic (direction-dependent) strength, surface-texture variation, dimensional variation within quoted tolerances, and color/finish variation between orders, materials, and machines.
- Unless a tighter tolerance is expressly stated in writing on your quote, the applicable tolerances are those published in the Manufacturing Policy ("Quoted Tolerances"). Products are evaluated against the Quoted Tolerances and your specifications, not against subjective expectations (see Quality Acceptance Policy).
- Material properties (including strength, temperature resistance, chemical resistance, UV stability, and dimensional stability) vary by material and process. You are responsible for selecting a material and process suitable for your application. We do not warrant fitness for any particular purpose unless we expressly agree in a signed writing.
- Environmental effects: printed parts may change over time with exposure to heat, sunlight/UV, humidity, solvents, or mechanical load. Resin parts in particular may become brittle or discolor with UV exposure. Functional or safety-critical use is at your risk and requires your own testing.
5. Design Responsibility
- Where you supply the design, you are solely responsible for the design, its dimensions, tolerances, fit, function, and suitability.
- Where we create work product for you (Section 13), we will do the work to the scope written in the Statement of Work and using reasonable care. Engineering review is limited to what is expressly stated in the Statement of Work. It is not a guarantee of performance, certification, or regulatory compliance unless expressly agreed.
5A. Engineering, Certification and Safety Disclaimer
Unless expressly agreed in a signed writing that specifically identifies the scope of work, we do NOT:
- certify, approve, or validate any design;
- certify or assess regulatory, code, or standards compliance (including FDA, FAA, DOT, NHTSA, UL, ISO, ASTM, or similar);
- perform finite element analysis (FEA), simulation, or stress, fatigue, thermal, tolerance-stack, or other engineering analysis;
- perform safety validation, medical or biocompatibility validation, aerospace validation, automotive validation, or any qualification, inspection, or engineering sign-off; or
- provide professional-engineer (PE) services or stamped/sealed engineering documents.
You remain solely responsible for the validation, testing, qualification, certification, and suitability of any item for its intended use, including all functional, load-bearing, safety-critical, medical, aerospace, automotive, and industrial applications.
Any informal manufacturability or design feedback we provide is advisory only, is not an engineering opinion, and does not transfer design or engineering liability to us.
6. Quotes, Order Acceptance and Pricing
- Instant quotes are estimates generated from automated geometry analysis and current pricing. Quotes are valid for 30 days unless stated otherwise and may be re-quoted if the file, quantity, or specifications change.
- We may decline or cancel any order before production, including for suspected infringement or Acceptable Use violations, file/manufacturability problems, pricing errors, or inability to meet requirements. If we cancel before production, your sole remedy is a refund of amounts paid for the cancelled items.
- A contract is formed when we accept your order (by charging payment and/or confirming the order), subject to Section 6.2.
- Prices exclude taxes and shipping unless stated. You authorize us to charge the total shown at checkout, including tax and shipping, via our payment processor (Stripe).
7. Cancellation
- Before production starts, you may request cancellation for a refund less any non-recoverable costs already incurred (for example, design work performed or custom materials ordered).
- Once production has started, orders generally cannot be cancelled because the goods are custom-made. See the Refund & Return Policy for limited exceptions.
- Engineering/design work already performed is billable through the point of cancellation.
8. Refunds, Reprints and Remedies
- Remedies for defective, wrong, or damaged items are governed by the Refund & Return Policy, which forms part of these Terms.
- Where we are at fault for a non-conforming item (outside Quoted Tolerances or not matching the accepted specification), our remedy at our option is reprint, repair, or refund of the affected items. This is your exclusive remedy for non-conforming goods.
- We do not provide refunds for items that conform to your files and the Quoted Tolerances, including dissatisfaction based on inherent process variation disclosed in the Manufacturing Policy.
8A. Payment Disputes and Chargeback Abuse
- You agree to contact us to resolve any order issue before initiating a payment dispute or chargeback, and to use the remedies in the Refund & Return Policy.
- Filing a payment dispute or chargeback does not cancel, suspend, or excuse your contractual obligations, including payment for conforming goods and services delivered or in production.
- In response to a payment dispute, you authorize us to submit to payment processors, card networks, banks, and dispute-resolution providers the records relevant to your order, including: uploaded files and Approved Materials (Section 16); generated previews and renders; quotes and specifications; material and option selections; your policy and consent acceptance records (with associated IP address, device/user-agent information, and timestamps); production and quality-control evidence (including photographs); and shipping and delivery records.
- A chargeback filed for a conforming custom item, or in place of the remedies in the Refund & Return Policy, is a breach of these Terms. Fraudulent or bad-faith chargebacks may be pursued through all available legal remedies, and you may be responsible for the disputed amount, related fees, and reasonable costs of collection.
9. Customer Responsibilities and Warranties
You represent, warrant, and agree that: (a) you have rights to all Customer Materials (Section 2.2); (b) your files and specifications are accurate and final; (c) you have selected appropriate materials and processes; (d) your order complies with the Acceptable Use Policy and all applicable laws and export controls; and (e) you will inspect items promptly on receipt and report defects within the window in the Refund & Return Policy.
10. Shipping and Risk of Loss
- Ship dates are estimates, not guarantees. We are not liable for carrier delays.
- Title and risk of loss pass to you upon our delivery of the goods to the carrier (FOB Origin / Ship Point). Claims for items lost or damaged in transit are between you and the carrier. We will reasonably assist and, where we purchased the label, may file or support claims.
11. Intellectual Property
- Customer Materials. As between the parties, you retain all ownership of your Customer Materials. You grant us the license in Section 2.3.
- Our Platform. We retain all rights in our website, software, quoting and automation systems, manufacturing methods, templates, libraries, tooling, and know-how (the "Platform IP"). Nothing transfers Platform IP to you.
- Work Product we create for you is governed by Section 13.
- Feedback you provide may be used by us without restriction or compensation.
12. Confidentiality and NDAs
- We treat Customer Materials as confidential and limit internal access to those who need it to provide the Services.
- If you require a non-disclosure agreement, you may use our platform NDA workflow. A countersigned NDA, where executed, governs the parties' confidentiality obligations and controls over conflicting terms in this Section.
13. Ownership of Work Product (CAD, Design, Reverse Engineering, Tooling)
- Unless a signed Statement of Work states otherwise, the Hybrid model applies: upon your payment in full, you receive ownership of the final deliverable files we create specifically for you (for example, the final CAD model and production drawings).
- We retain ownership of, and you receive no rights in, our pre-existing and reusable assets, including manufacturing methods, parametric templates, component libraries, tooling/fixtures, quoting and pricing systems, automation, internal workflows, and general know-how ("Reusable Components"), even where embodied in or used to create a deliverable. We grant you a license to use any Reusable Component only to the extent embedded in your final deliverable and only for your use of that deliverable.
- Until payment in full, all Work Product remains our property and you have no license to use it. (See Part 8 for full models and assignment language.)
- Reverse engineering. Where you request reverse-engineering services, you represent and warrant that you own the physical part or have all legal rights necessary to have it reverse-engineered and reproduced. We do not determine, and are not responsible for determining, whether a part or design is protected by patent, copyright, trade secret, contractual restriction, or any other right. You are solely responsible for the legality of the requested reverse-engineering work, and you indemnify us for any breach of this Section (Section 15).
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. Without limiting the foregoing, we will not be liable for: business interruption; production stoppage, downtime, or loss of production or manufacturing time or capacity; equipment or production-line shutdown; product recall, withdrawal, or field action, or the cost of any recall, rework, repair, or retrofit; cost of cover or of substitute goods or services; damage to other products, assemblies, equipment, or property into which an item is incorporated; or any downstream, end-customer, or third-party losses or claims, in each case arising from or related to the Services, the products, or any item's use, failure, or non-conformity.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO AN ORDER WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US FOR THAT ORDER.
No warranty for end use. You assume all risk for the suitability, performance, and safety of items in your application. THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.
Nothing limits liability that cannot be limited by law.
15. Indemnification
You will defend, indemnify, and hold harmless 3D Services USA and its members, officers, and employees from any third-party claim, loss, or expense (including reasonable attorneys' fees) arising from: (a) your Customer Materials or their manufacture; (b) your breach of these Terms or the Acceptable Use Policy; (c) your infringement or alleged infringement of any IP or other right; or (d) your use of any item.
16. Production Approval, Approved Materials, and Errors
- Authorization to manufacture. Your approval of any proof, render, preview, CAD file, drawing, specification, configuration, or production file ("Approved Materials") constitutes your authorization to manufacture the item as shown in those Approved Materials, and is part of your acceptance of the order.
- Responsibility for errors in Approved Materials. You are responsible for reviewing Approved Materials before approval. We are not responsible for errors, omissions, or defects present in Approved Materials (including in your own files), and an item that conforms to the Approved Materials and the Quoted Tolerances is conforming even if the Approved Materials contained an error.
- Approved Materials as order record. Approved Materials, together with the date, time, and method of approval, become part of the order record and our dispute-defense evidence package, and may be submitted to payment processors and dispute-resolution providers in connection with any payment dispute (Section 8A; Refund & Return Policy).
17. Force Majeure
We are not liable for delay or failure to perform due to events beyond our reasonable control, including supply-chain disruption, material shortages, equipment failure, labor issues, utility/internet outages, carrier failures, natural disasters, pandemics, or government action.
18. Dispute Resolution; Arbitration; Class-Action Waiver
- Informal resolution first. Before filing any claim, you agree to contact us at legal@3dservicesusa.com and attempt to resolve the dispute informally for at least 30 days.
- Binding arbitration. Except for the carve-outs below, any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules, seated in Wyoming, rather than in court.
- Class-action waiver. Disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative action.
- Carve-outs. Either party may bring an individual claim in small-claims court, and we may seek injunctive relief to protect IP or enforce the Acceptable Use Policy.
- Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@3dservicesusa.com.
19. Governing Law and Venue
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. Subject to Section 18, the exclusive venue for any permitted court action is the state or federal courts located in Wyoming.
20. Changes to the Terms
We may update these Terms. Changes apply prospectively. The version in effect at the time of your order governs that order. We will notify you of material changes by email and in-app notice. Continued use after changes constitutes acceptance.
21. Incorporated Policies
The following are incorporated by reference and form part of these Terms: Manufacturing Policy, Quality Acceptance Policy, Refund & Return Policy, Intellectual Property Policy, Acceptable Use Policy, Regulated Activities, Export Control & Restricted Projects Policy, and Privacy Policy. The version of each policy in effect at the time of your order governs that order.
22. General
Entire agreement; severability; no waiver; assignment (you may not assign without our consent; we may assign to an affiliate or successor); notices; survival of Sections 2, 3A, 5A, 8, 8A, 9, 11, 13, 14, 15, 16, 18, 19, and 21.
